Terms and Conditions of Sale – Fux Laboratories

1. Introduction and purpose of these general terms and conditions of sale

The following general terms and conditions of sale (hereinafter referred to as "GTC") apply to all product sales made by Fux Laboratories, via its website fux-labs.fr or through direct sales. The products offered for sale include fantasy silicone sex toys, handcrafted, as well as merchandise (mugs, t-shirts, stickers, etc.).

Purchasing products on the fux-labs.fr website implies the customer's unconditional acceptance of these GTC. Fux Laboratories reserves the right to modify these terms at any time. The applicable GTC are those in force at the time the order is placed.

2. Characteristics of the products offered for sale

All products sold by Fux Laboratories are carefully described on the website. The silicone sex toys are handcrafted using hypoallergenic, non-toxic materials that comply with current European standards. The merchandise (mugs, t-shirts, stickers, etc.) may be personalized or not, and their visuals are faithfully reproduced on the site. However, color variations may occur depending on screens and display settings.

The photographs and descriptions of the products on the fux-labs.fr website are contractual. In the event of a manifest error, Fux Laboratories undertakes to inform the customer as soon as possible and to offer an appropriate solution (replacement, refund, etc.).

3. Order and payment methods

Placing an order

The order is considered final after confirmation by email sent by Fux Laboratories to the customer. This confirmation includes all information related to the order (product references, prices, shipping costs, etc.). Fux Laboratories reserves the right to cancel or refuse any order in case of product unavailability, pricing error, or suspicion of fraud.

Accepted payment methods

Payment is made exclusively online via PayPal. Payment is due immediately upon order confirmation. No order will be shipped until payment has been received by Fux Laboratories.

Discretion option

Fux Laboratories offers a discretion option for packages. At the customer's request, the sender's name can be hidden on the package label to preserve anonymity.

4. Product delivery

Delivery methods

Products are delivered to the address provided by the customer during the order process, via Colissimo home delivery. Shipping costs are entirely the responsibility of the customer and correspond to the carrier's current rates, without any additional markup by Fux Laboratories.

Package tracking

An email containing a tracking link is sent to the customer as soon as the package is shipped. This link allows real-time tracking of the package until delivery. The customer must provide a valid email address and phone number to facilitate communication with the carrier if necessary.

Delivery times

Delivery times are provided for informational purposes and may vary depending on carrier-related issues or exceptional circumstances (strikes, bad weather, etc.). Fux Laboratories cannot be held responsible for delivery delays attributable to the carrier.

5. Right of withdrawal

In accordance with current regulations, the customer has a 14-day withdrawal period from the date of receipt of the package to return the ordered products, without having to justify the reasons or pay penalties.

Return conditions

To exercise the right of withdrawal, the customer must inform Fux Laboratories of their decision by email at contact@fux-labs.fr. Products must be returned unused, in their original sealed packaging, to the address provided by Fux Laboratories. Return shipping costs are the responsibility of the customer.

Refund

Upon receipt and verification of the returned products, Fux Laboratories will refund the customer within 14 days, using the same payment method as the original order.

6. Legal warranties and hidden defects

Legal warranty of conformity

Fux Laboratories guarantees that the products sold conform to their description and are free from manufacturing defects. In the event of proven non-conformity, the customer may request a replacement or refund of the product, subject to providing proof of purchase.

Hidden defects warranty

Products are guaranteed against hidden defects for a period of 2 years from the delivery date. The customer must report any hidden defect as soon as possible, providing a precise description and, if possible, photographs. Fux Laboratories reserves the right to inspect the product before any action is taken.

Warranty exclusions

The warranty does not cover damage resulting from misuse, negligence, or modification of the product by the customer.

7. Liability of the seller and the customer

Liability of Fux Laboratories

Fux Laboratories undertakes to deliver products that are compliant, safe, and suitable for their intended use. In the event of failure to meet this obligation, the liability of Fux Laboratories may be engaged within the limits provided by law.

Customer liability

The customer undertakes to check for any apparent defects on the product before opening the seal. In case of a defect or non-conformity, the customer must immediately contact Fux Laboratories to arrange the return of the product and allow the necessary inspection.

8. Protection of personal data

Fux Laboratories is committed to complying with the GDPR regulations in force. The personal data collected (name, first name, email, phone, address) are used solely for order management, delivery, and after-sales service. This data is retained for a period of 3 years from the last contact with the customer.

The customer has the right to access, rectify, delete, and object to the use of their data. To exercise these rights, they can contact Fux Laboratories at contact@fux-labs.fr.

9. Intellectual property

All elements of the fux-labs.fr website (texts, images, designs, logos) are the exclusive property of Fux Laboratories and are protected by copyright and intellectual property laws. Any reproduction, representation, or counterfeiting, in whole or in part, is strictly prohibited and may be subject to legal action.

10. Disputes and applicable law

These GTC are governed by French law. In the event of a dispute, the courts within the jurisdiction of the Bordeaux Judicial Court shall have sole jurisdiction.

In the event of a persistent disagreement, the customer has the option to use a consumer mediator to attempt to resolve the dispute amicably.
